Seeing Eye to Eye on Child Custody

When a married couple files for divorce, it is not only the division of their assets that often becomes an issue, but the custody of their children as well. In fact, it is common for children to get caught in the crossfire of divorce. If you and your spouse can’t agree on parenting arrangements, you can seek help from the courts for mediation, in which case you need to consult with an Orlando family law attorney to guide you through this complex process.
Best Interests”
The court’s decision will always be based on the child’s best interests. A judge would consider a parent’s ability to raise the child properly based on factors laid out by the state’s law, covering a child’s health and safety, emotional and developmental needs, moral fitness, and the parents’ ability to instill upon their child no ill feelings toward the other parent. Often, Florida courts would favor joint legal custody unless they are able to prove that this arrangement could be detrimental to the child.
Mediation Tips
Your attorney will advise you on fair parenting arrangements. Keep in mind that it’s important to be willing to listen to your spouse, and not to belabor the matter when you can agree on certain points. Amicable talk can foster a healthier environment for your children, knowing that they can express their feelings about the whole ordeal, and be able to influence or contribute to the final decision that would be best for all.

  1. Great post Richard. Many people think that parents inherently have rights, however, as you said, the court will always determine what is in the best interests of the child. It some cases, the court may grant custody to another significant family member such as a grandparent, if it is deemed in the best interests of the child. As a child custody attorney Sydney, the few situations I have seen this occur has been when there has been a case of domestic violence or abuse in the family. Is this usally the case in Orlando as well?
